By accessing, browsing, or using our website, applications, APIs, integrations, services, or any related platforms (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy and Acceptable Use Policy.
If you do not agree to these Terms in their entirety, you must not use the Service. If you are accessing the Service on behalf of a company, organization, or entity, you represent and warrant that you have full authority to bind that entity to these Terms.

1. Grant of License and Restrictions
Subject to your compliance with these Terms, Vivara grants you a limited, personal, non-exclusive, non-transferable, and revocable license to access and use the Service solely for lawful purposes and in accordance with these Terms. You may not:
- Reproduce, modify, distribute, sell, or rent any portion of the Service;
- Use automated tools (bots, scrapers, crawlers) to access or extract data from the Service except as expressly permitted in writing;
- Reverse engineer, decompile, or disassemble the Service or attempt to derive its source code, algorithms, or trade secrets;
- Use the Service to develop, operate, or promote any competing service or product;
- Circumvent, disable, or interfere with any security features, rate limits, or access controls;
- Upload, post, transmit, or otherwise make available any malware, harmful code, or content that violates applicable law or third-party rights;
- Use the Service in any manner that could damage, impair, or degrade the Service or interfere with other users' access or enjoyment.
2. User Accounts and Credentials
If you create an account to use the Service, you are responsible for maintaining the confidentiality of your login credentials and password. You agree to:
- Provide accurate, current, and complete information when creating or updating your account;
- Immediately notify Vivara of any unauthorized use of your account or suspected security breach;
- Accept full responsibility for all activities that occur under your account, whether or not you authorize them;
- Not share your account credentials with third parties or permit unauthorized access;
- Comply with any account use restrictions or policies communicated by Vivara.
Vivara may suspend or terminate accounts that remain inactive for extended periods or that are used in violation of these Terms or applicable law.
3. Acceptable Use and Content Standards
You agree to use the Service only in compliance with these Terms and all applicable laws, regulations, and third-party rights. You shall not upload, post, transmit, display, or otherwise make available:
- Content that infringes, misappropriates, or violates any patent, trademark, trade secret, copyright, right of publicity, or other intellectual property or proprietary right;
- Content that is unlawful, fraudulent, deceptive, obscene, defamatory, libelous, or otherwise harmful;
- Content that promotes, encourages, or facilitates violence, terrorism, self-harm, or illegal activity;
- Content that exploits, endangers, or sexualizes minors in any manner;
- Personal data, sensitive information (including health records, government IDs, payment information), or confidential information belonging to others without proper authorization and legal basis;
- Unsolicited commercial communications, spam, or advertising (except as part of services you have subscribed to);
- Content designed to probe, scan, or test system vulnerabilities, security features, or integrity.
Vivara reserves the right to remove any content that violates these provisions and to impose restrictions or suspend access without prior notice if violations are detected.
4. Intellectual Property Rights
All content, features, functionality, designs, graphics, text, logos, images, and code comprising the Service ("Vivara IP") are and shall remain the exclusive property of Vivara or its licensors. Vivara IP is protected by copyright, trademark, and other intellectual property laws of India, the United States, and other jurisdictions. Your use of the Service does not grant you ownership of any Vivara IP.
You retain all ownership and intellectual property rights in any content you create and upload to the Service ("User Content"). However, by uploading User Content, you grant Vivara a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, display, perform, distribute, and create derivative works from User Content as reasonably necessary to operate, maintain, and improve the Service and for internal business purposes.
You represent and warrant that you own or have all necessary rights to grant the license described above and that User Content does not infringe any third-party rights.
5. Limitation of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. VIVARA DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. VIVARA DOES NOT WARRANT THAT:
- The Service will be uninterrupted, error-free, or free from defects;
- Any defects in the Service will be corrected;
- The Service or the servers hosting it are free from viruses or other harmful components;
- Results obtained from using the Service will be accurate or meet your expectations;
- The Service will function on all devices or with all browsers.
Some jurisdictions do not allow the exclusion of implied warranties, and this disclaimer may not apply to you to the fullest extent legally permissible.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VIVARA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, BUSINESS INTERRUPTION, OR REPUTATIONAL HARM, EVEN IF VIVARA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
In any case, Vivara's total aggregate liability arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the fees paid by you in the twelve (12) months immediately preceding the claim, or (b) USD 100. This limitation applies whether liability arises from breach of warranty, breach of contract, tort (including negligence), or any other legal theory.
Some jurisdictions do not allow the limitation or exclusion of liability, and this limitation may not apply to you to the fullest extent legally permissible.
7. Indemnification
You agree to indemnify, defend, and hold harmless Vivara, its officers, directors, employees, agents, and successors from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from or relating to:
- Your use or misuse of the Service;
- Your violation of these Terms or applicable law;
- Your infringement or misappropriation of any third-party intellectual property, privacy, or publicity rights;
- Any User Content you upload, post, or transmit;
- Your interaction with other users or third parties in connection with the Service.
8. Termination and Suspension
Vivara may, in its sole discretion, suspend or terminate your account and access to the Service immediately, without prior notice or cause, if you violate these Terms, our Acceptable Use Policy, or applicable law. Upon termination, your right to access the Service ceases immediately, but your obligations under these Terms survive indefinitely. Vivara is not liable for any consequences resulting from suspension or termination of your account.
9. Privacy and Data Protection
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, process, use, and protect your personal data. By using the Service, you consent to such collection, processing, and use as described in the Privacy Policy. If there is any conflict between these Terms and the Privacy Policy, the Privacy Policy shall govern matters relating to personal data.
10. Third-Party Links and Content
The Service may contain links to third-party websites, applications, or services that are not operated by Vivara. Vivara is not responsible for the content, accuracy, or practices of any third-party site, and your use of third-party services is at your own risk and subject to their terms and conditions. Vivara does not endorse any third-party site or product.
11. Modifications to the Service and Terms
Vivara reserves the right to modify, suspend, or discontinue the Service, or any portion thereof, at any time, with or without notice. Vivara may also modify these Terms at any time. Material changes will be effective upon posting to the Service or upon notification to you. Your continued use of the Service following the posting of revised Terms constitutes your acceptance of the changes. It is your responsibility to review these Terms periodically.
12. Governing Law and Jurisdiction
These Terms and your use of the Service are governed by and construed in accordance with the laws of the Republic of India, without regard to conflict of law principles. You irrevocably submit to the exclusive jurisdiction of the courts located in Bengaluru, India for resolution of any disputes arising from or relating to these Terms or the Service. You waive any objection to venue or inconvenient forum.
13. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if such modification is not possible, the provision shall be severed, and all other provisions shall remain in full force and effect.
14. Entire Agreement
These Terms, together with the Privacy Policy and Acceptable Use Policy, constitute the entire agreement between you and Vivara regarding the Service and supersede all prior and contemporaneous agreements, understandings, and communications, whether written or oral.
