Acceptable Use Policy

This Acceptable Use Policy (AUP) describes what you may and may not do when using AFGENIE (the Service), including any related websites, APIs, integrations, and WhatsApp or other messaging interfaces provided by Vivara Interactive Studios (OPC) Private Limited (we, us).
By using the Service you agree to comply with this AUP. If you do not agree, you must not use the Service. We may update this AUP from time to time. Material changes will apply on a go-forward basis.

1. Scope
This AUP applies to:
- all content you upload, ingest, or otherwise make available through the Service (Customer Content); and
- all use of the Service and its outputs by you and anyone acting under your account, tenant, or workspace.
You are responsible for all activity under your account and for ensuring that your end users comply with this AUP.
2. Prohibited content
You must not upload, ingest, store, or process any content through the Service that:

Infringes rights
- violates or infringes any copyright, trade mark, trade secret, database right, or other intellectual property or proprietary right;
- violates publicity or personality rights.

Is illegal or regulated without authority
- is unlawful under applicable law;
- relates to activities that are illegal (for example, fraud, money laundering, terrorism, child exploitation, or the sale of illegal goods);
- consists of regulated or highly sensitive data (including patient health records, government identification numbers, payment card data, and similar) unless you have all necessary rights, legal basis, and agreements in place with us to process such data.

Is harmful, abusive, or unsafe
- contains malware, viruses, worms, ransomware, or other malicious code;
- is designed to harass, bully, defame, threaten, or incite violence against any person or group;
- promotes self-harm, suicide, or serious physical injury;
- promotes terrorism, violent extremism, or organised criminal activity.

Is discriminatory or exploitative
- promotes hatred or discrimination based on race, ethnicity, nationality, religion, disability, sex, gender identity, or sexual orientation;
- exploits or endangers children or vulnerable individuals in any way.

Violates privacy
- contains personal data for which you lack a valid legal basis, required notices, or consents;
- is uploaded in breach of confidentiality obligations, NDAs, professional secrecy, or court orders.
If you are unsure whether you are allowed to upload specific content, do not upload it.
3. Prohibited behaviour
You must not, and must not allow others to:

Abuse or attack the Service
- attempt to probe, scan, or test the vulnerability of the Service or our infrastructure;
- attempt to bypass or defeat authentication, rate limits, usage controls, or security features;
- interfere with or disrupt the Service or the systems or networks of any other user.

Misuse accounts or identities
- share passwords or access tokens outside your organisation;
- impersonate any person or entity, or falsely claim affiliation with any person or entity;
- access or use any account that does not belong to you without permission.

Misuse outputs
- present AI-generated outputs as if they were guaranteed fact, legal advice, medical advice, or other professional advice;
- use outputs to generate spam, phishing, social engineering attacks, or misleading or deceptive content;
- use outputs in ways that violate third-party rights, including copyright and privacy.

Misuse of automation / API
- use bots, scripts, or automated systems that overload or materially degrade the Service;
- exceed any documented or agreed rate limits, quotas, or fair-use thresholds;
- scrape or systematically harvest data from the Service, except as expressly permitted by us in writing.

Reverse engineering and competition
- reverse engineer, decompile, or attempt to extract the underlying models, source code, or trade secrets of the Service;
- use the Service to create a competing database or AI service by bulk copying outputs, prompts, or prompts plus outputs pairs, except as permitted in your written agreement with us.
4. Personal data and confidentiality
You are responsible for:
- ensuring you have a valid legal basis (such as consent, contract, or legitimate interests) for any personal data you upload;
- complying with applicable data-protection and privacy laws;
- honouring your own privacy notices, contracts, and confidentiality obligations.
You must promptly remove any content from the Service if you lose the right to use it, and you must stop using related outputs.
5. Use of outputs
Outputs from the Service may be inaccurate, incomplete, or out of date. They are provided for information only and do not constitute legal, medical, financial, or other professional advice.
You are solely responsible for:
- reviewing and verifying outputs before using them;
- how you rely on, share, or act on outputs; and
- any consequences arising from your use of outputs.
6. Reporting abuse
If you believe this AUP is being violated, please notify us at:
Include as much detail as possible (tenant or workspace ID, timestamps, description, and any relevant screenshots or logs).
7. Enforcement
We may, in our sole discretion and without prior notice, take any of the following actions if we reasonably believe this AUP has been or may be violated:
- warn the relevant user or workspace;
- pause ingestion or processing of specific content;
- quarantine, restrict access to, or delete specific content;
- temporarily suspend or permanently disable access to some or all of the Service;
- report matters to law enforcement or other authorities where required or appropriate.
Where reasonable, we will try to limit action to the narrowest scope necessary to resolve the issue (for example, a single workspace, user, or integration).
8. Relationship to other terms
This AUP forms part of and is incorporated into our Terms of Service and any other agreement between you and us governing the use of the Service. If there is any conflict, the main Terms of Service will prevail to the extent of the conflict.
